Court recognises low involvement of Campine in battery case

On November 7, 2019, the General Court of the EU communicated its verdict in the appeal of Campine against the European Commission’s decision to penalise Campine for alleged participation in a purchase cartel in the European market of car battery recycling (case 40018 communicated by the EU commission on 8/2/2017).

The court’s verdict is to reduce the imposed fine with 3,9 mio € to 4,3 mio € from an original amount of 8,2 mio €.

“We are glad the court already recognized the very low involvement of Campine in the alleged cartel actions in the period 2009 – 2012” comments chairman Patrick De Groote, “We are still of the opinion that Campine did not actively participate in a cartel formation but was dragged along into this by one of our customers.” he adds. Campine is now awaiting the detailed motivation of the court and the reaction of the EU commission to assess its legal options
