Shareholders don't have claims, they are equity in the company, ownership, and the only way they'd ever see a recovery in a Chapter 7 bankruptcy is if the proceeds from the asset sales covered every penny of debt. That ain't happening here.

sleven, another explanation can be that Sarissa used their off shore fund to move the 8.6mill shares hence the explanation for the 24mill holdings, then back up to their original position of 33,470,000 when they transferred the shares back to reduce their cost.
