UPDATE: Justice Department Seeks More Info From Nasdaq On NYSE Approach

The U.S. Department of Justice has asked Nasdaq OMX Group Inc.
(NDAQ) for more detail on the company's proposed takeover of NYSE
Euronext (NYX), following an additional request for information
last week.
Antitrust authorities in Washington on Friday sought "additional
information and documentary material" from Nasdaq OMX after
initially seeking such materials last Wednesday, according to a
regulatory filing by the exchange operator Monday.
The biggest U.S. regulatory hurdle to Nasdaq OMX's proposal is
the prospect of combining nearly all U.S. share listings under a
single parent. Nasdaq OMX and NYSE Euronext compete intensely to
lure U.S. companies to their markets, but Nasdaq OMX has argued
that the U.S. would be in a stronger position globally if it
boasted a unified platform for capital raising.
The Justice Department's "second request" for information was
widely expected. It signals progress in efforts by Nasdaq OMX and
IntercontinentalExchange Inc. (ICE), its partner in a joint
proposal to buy NYSE Euronext, to ensure that regulators' review
the ICE-Nasdaq approach keeps pace with the Big Board's agreed deal
to merge with Deutsche Boerse AG (DB1.XE, DBOEF).
European and U.S. authorities are already looking over that
deal, announced in mid-February.
"We're encouraged by the DOJ's desire to fast track the process
so that it is reviewed in a timely fashion giving shareholders time
to judge our superior proposal on its merits," a spokesman for
Nasdaq OMX said Monday.
A Justice Department spokeswoman said its investigation was
ongoing and declined to comment further. A representative for NYSE
Euronext declined comment.
Nasdaq OMX Chief Executive Robert Griefeld in mid-April
estimated that the exchange would get guidance from the Justice
Department within six or seven weeks.
NYSE Euronext shareholders are slated to vote on the Deutsche
Boerse combination on July 7.
