A judge will rule in December whether South Africa's Department of Mineral Resources incorrectly awarded an iron ore license to a small controversial company rather than Kumba Iron Ore Ltd. (KIO.JO), the miner said Thursday.

Kumba Iron Ore, majority owned by Anglo American PLC (AAUKY), took the department to court saying DMR was wrong to award a 21.4% lapsed stake to the Sishen mine previously owned by ArcelorMittal South Africa to Imperial Crown Trading. Kumba owns the remaining mining right.

Kumba said that the judge, who heard the case in August, will give his ruling Dec. 15.
