    Statement re Protection

    Following the announcement on 3 October 2008 regarding the trading position and the need for additional funding and the subsequent
request on 7 October 2008 by the Company that its shares be suspended pending clarification of the Group's financial position, Ashton Penney
Holdings Plc entered into a ten-day period of protection under insolvency rules with effect from 28 October 2008, and will work with its
recovery advisors to assess its options.

    Those options include possibly the sale of some or all of the company's assets and/or a refinancing of the company.
